These Terms of Service are an agreement between you and TriEd Research Associates LLC ("we," "us," or "our") governing use of TriedSecureTest, an educational assessment administration platform. By creating an account, administering an assessment, or submitting responses as a student, you agree to these terms.
Use of TriedSecureTest is also governed by our Privacy Policy, located at /privacy, which explains what information is collected, how it is used, and where it is stored and processed.
If you are accepting these terms on behalf of a school or district, you confirm that you are authorized to do so.
TriedSecureTest is intended for lawful educational assessment purposes at the direction of educators, schools, and school districts. It is not intended for administering assessments outside an educational setting or for any unlawful purpose.
Teacher accounts are intended for educators and authorized school or district staff. Accounts are individual. You are responsible for protecting your account credentials, for all activity under your account, and for notifying us promptly if you believe your credentials have been compromised.
Students do not create accounts. They reach an assessment through the link, password, and identifier provided by their teacher.
Depending on how an assessment is configured, the platform may limit the time available, limit the number of attempts, count tab switches or periods of the browser losing focus, restrict copying and pasting, and take an action after the teacher's configured number of warnings, such as warning, auto-submitting, locking, or invalidating the attempt. Students see these warnings while testing.
Monitoring is limited to the features described above and to what the browser reports. It is not comprehensive and it cannot detect every form of academic dishonesty. Results of monitoring should be treated as signals for a teacher's judgment, not as proof of misconduct.
Written assessment responses may be processed using artificial-intelligence services when teachers use AI-assisted scoring, feedback, plagiarism, or related functionality. Written responses may also be compared with publicly available Internet sources for plagiarism or similarity analysis.
These features are provided to assist teachers and are not guaranteed to be accurate, complete, or consistent. They can produce incorrect scores, miss plagiarism, or flag original work. Automated scores remain subject to teacher review and override, and the teacher-approved score is the score of record. TriedSecureTest does not represent automated scoring as a substitute for educator professional judgment.
Schools and districts retain their rights in the student education records involved in assessments administered through TriedSecureTest. TriEd Research Associates LLC does not claim ownership of student education records merely because they are processed through TriedSecureTest.
Teachers retain ownership or applicable rights in original assessment material they create, subject to third-party intellectual-property rights in any material they upload or import. Student information and assessment content may be processed only as necessary to provide TriedSecureTest functionality, security, and support, or to meet applicable legal obligations.
TriedSecureTest may use authorized infrastructure and technology providers, including Base44 and services made available through the Base44 platform, to provide hosting, database, security, monitoring, communications, artificial-intelligence, and related technical services. Information about data storage, processing, and subprocessors is described in our Privacy Policy and in Base44's Trust Center.
You agree not to:
Where the platform is offered as part of a pilot, it is provided on an as-available basis, features may change or be withdrawn, and downtime may occur without notice. Pilot access may end for a school or district with reasonable notice. Any fees, if applicable, are set out separately in a written agreement or order form.
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error free, or that automated scores, feedback, or plagiarism results will be accurate.
To the fullest extent permitted by law, TriEd Research Associates LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost grades, data, or opportunities arising from use of the service. Where liability cannot be excluded, our total liability is limited to the amount paid for the service in the twelve months before the claim.
You may stop using the service at any time, and a school or district may request closure of its accounts. We may suspend or terminate access if these terms are violated, if required by law, or if use creates a security or legal risk. On termination, records are handled as described in our Privacy Policy.
We may update these terms as the service changes. The date at the top of this page shows when they were last revised. Continued use after an update means you accept the revised terms; material changes will be communicated to account holders.
These terms are governed by the laws of the United States and of the state in which TriEd Research Associates LLC is organized, without regard to conflict-of-law rules. Questions about these terms can be sent through the contact form on our home page or by email at triedassociates@att.net.
